Identity theft is one of the fastest growing crimes in Ohio. It can happen over a variety of platforms from accessing information on a computer, over the internet, or through the mail to acquire money or obtain access to items that are not their own.

Identity theft can be defined according to the Ohio Revised Code (ORC 2913.49) as using, obtaining, or possessing personal information of another individual without their permission and having the intent to either impersonate that individual or use their information as though it is yours. Personal information encompasses another individual’s name, address, social security number, phone number, and driver’s license.

You may also be convicted of identity theft if you:

  • Create, obtain, possess or use another individual’s personal information to assist you in impersonating that person or if you use that information as yours.
  • If you allow another individual to use your personal information, while having the intent to commit fraud.
  • If you attempt to defraud other individuals using your own information.

If you are facing an identity theft conviction, the resulting penalties will depend on the facts and circumstances of your case. The length of your prison sentence and the amount you will owe in fines depends on the monetary amount that the victim was defrauded.

If the value that is defrauded is less than $5,000 this is considered a fifth-degree felony offense. You will face at least six months and up to 12 months in prison, in addition to $2,500 in fines.

If the value that is defrauded is between $5,000 and $100,000, this is considered a fourth-degree felony offense. You fill face at least six months and up to 18 months in prison, in addition to up to $5,000 in fines.

If the value that is defrauded is more than $100,000, this is considered a third-degree felony offense. You will face at minimum one year and at most five years in prison, in addition to up to $10,000 in fines.
