Domestic Violence Charges in Silverton

In general, domestic violence in Ohio is defined as an incident where a family or household member is physically harmed or threatened with physical harm. The definition of a family or household member is more broad than just a spouse or a blood relation and can also include former spouses, the family of a current or former spouse and the natural parent of a child where the offender is the other natural parent. Even someone a person lived with up to five years earlier can be considered a family or household member for the purpose of domestic violence charges.

The domestic violence law in Ohio has defined three types of actions that would be considered domestic violence offenses:

  • Knowingly causing or attempting to cause physical harm to a family or household member. This is considered a 1st Degree Misdemeanor, and you could face up to 6 months in jail and $1,000 in fines.
  • Recklessly causing serious physical harm to a family or household member. This is considered a 1st Degree Misdemeanor, and you could face up to 6 months in jail and $1,000 in fines.
  • Knowingly, by threat of force, causing a family or household member to believe the offender will cause imminent physical harm to the family or household member. This is considered a 4th Degree Misdemeanor, and you could face up to 30 days in jail and $250 in fines.

The penalties for domestic violence become much more severe if the victim of the offense was pregnant or if the offender has previous domestic violence convictions. In those situations, a domestic violence offense could be elevated to a felony and the offender could face a mandatory prison term.
