Aggravated Menacing Charges Dismissed For A Young Veteran

Posted On: April 26th, 2016 by Bradley J. Groene

In Hamilton County, a man in his mid-20’s, who had previously served in Iraq and Afghanistan found himself in a terrible legal situation, when a neighbor accused the man of pointing a firearm at him. The neighbor contacted the police, who charged the young man with aggravated menacing. The offense of aggravated menacing is considered a first-degree misdemeanor, and if convicted, would result in a permanent criminal record, a sentence of up to 180 days in jail, and possibly a $1,000 fine. With no prior criminal history, the young veteran was very nervous about these life-altering ramifications and reached out to the criminal defense attorneys at Luftman, Heck & Associates.

Attorney Bradley J. Groene consulted with his client, who adamantly claimed that his neighbor’s allegation was untrue and he did nothing wrong. Attorney Groene attempted to discuss the merits of the case with the prosecutor’s office; however, it was apparent the assigned prosecutor was uninterested in negotiating. Consequently, the defense prepared for a trial over a few court appearances, where attorney Groene planned to present his client’s case and prove his innocence. Eventually, when the trial date was finally set, the prosecution dismissed the aggravated menacing charge entirely, rather than proceeding with a trial, relieving the young man of this substantial burden.
